Analytic philosophy and modern logic are intimately connected, both historically and systematically. Thinkers such as Frege, Russell, and Wittgenstein were major contributors to the early development of both; and the fruitful use of modern logic in addressing philosophical problems was, and still is, definitive for large parts of the analytic tradition. More specifically, Frege's analysis of the concept of number, Russell's theory of descriptions, and Wittgenstein's notion of tautology have long been seen as paradigmatic pieces of philosophy in this tradition. Relying on Husserl as well as on the reflections by Merleau-Ponty on Cézanne, Henry on Kandinsky and Deleuze on Bacon, this essay sketches some basic problems that arise in a phenomenological account of non-figurative painting. An investigation of the distinction between phenomenological and pictorial perception, of the transposition of the painter’s mode of perception into a painted image, and of the expressive force of paintings inevitably confronts one with the enigma of the appearing of something invisible. The essay proceeds in (...) three steps. The first step describes pictorial perception in terms of a ‘seeing according to’. Such a mode of perception pays attention to visual ambiguities, to the ‘gaze of things’ and to the conditions of visibility that are ordinarily overlooked. The second step moves on to the issue of the transposition of a pictorial perception in a painted image. Deleuze’s account of “manipulated chance” proves to be very helpful here. In the final step, Henry’s and Deleuze’s emphasis on the painting’s expression of totally invisible ‘forces’ is discussed. (shrink)

In a familiar interpretation, the Non-Identity Problem claims that persons whose existence depends on a seemingly harmful action cannot in fact be harmed through such an action. It is often objected that the persons in question can nevertheless be wronged through a violation of their rights. However, this objection seems to fail because these persons would readily waive any violated right in order to come into existence. The present article will analyze this Waiver Counter Argument in detail and show why (...) it does not succeed. First, it is necessary to distinguish between a prospective and a retrospective waiver scenario. In the prospective scenario an imagined person must consider whether she wants to waive a right in order to come into existence. In the retrospective scenario a person is asked whether she would prefer a wronged existence to never having been born. In both scenarios the conditions of a legitimate waiver of rights are not met, but for different reasons. On this basis, an argument against NIP can be developed. (shrink)

We ask how much we can gather from existing theory about the localization of an event and point out that decoherence and coarse graining—though important—do not suffice for a consistent interpretation without the additional principle of random realization.

My purpose is to examine Kant's views on interpreting nature and history and to attempt to see them as coherent by relating them to his theory of reflective judgment. With this reconstruction of a kantian conception of interpretation it is possible to shed new light on kant's approach to political history. I propose that reflective judgments as defined in the "critique of judgment" be conceived primarily as interpretive and only derivatively as either aesthetic or teleological. This article contains a summary of selected theses of the theory of the state developed by Hermann Heller, who was one of the leading representatives of the so-called Weimar Theory of the State. State theorists of the Weimar era formed an independent, formally unrelated group of scientists who had often opposing views, but were united by a common effort to conduct even philosophical investigation of the nature of the state, the European, continental state, as well as its internal ratio and (...) mission. In addition to Hermann Heller, this group included Carl Schmitt, Rudolf Smend, Erich Kaufmann and Heinrich Triepel. They asked questions which are absent in today’s science, such as: “What is a state?”, “What kind of being is it and what is its nature?”. The answers determine many issues, including our perception of the durability and strength of the state, our understanding of its structure and development, the relation between the state and the individual and the relation between politics and history, etc. No settlement of this basic issue is not only simple negligence, but – as can be judged – it stems from today’s tacit assumption that the state is not a being, but only an artificial human construct, a combination of elements and a set of institutions. Heller perceives the state substantially: as particular organization of social affairs; organization of specific areas of public life: economy, law and public opinion. These were created in the modern era and have been specific to Europe from the sixteenth century to modern times. The matter of these areas is transformed into a state order by sovereign authorities. Therefore, their policies and their law have their concrete object whose reality they face, and they need to demonstrate that they are capable of organizing this reality. The ethos of the state and at the same time the legitimacy of its power require that elementary principles of justice are ensured, or at least injustice is eliminated from social life. (shrink)

A correct understanding of what Freud means by “pleasure” and what he thinks of the possible ways to obtain pleasure requires an examination of his conceptions of the drive and of the libidinal body. Both theories are built on a variety of traditional philosophical views, the examination of which can help to overcome some of their obscurities. The reference to Leibniz and his Aristotelian understanding of the relation between pleasure and the force (vis activa) which animates the substance and maintains (...) it in constant movement allows an account of what in the drive preserves it from total exhaustion and a consequent reversal of pleasure into displeasure. Similarly, an examination of Schopenhauer's conception of the human body clarifies what Freud says about the “pleasure of the organ”. The necessity for the drive to invest a body is given thereby a metaphysical foundation. Furthermore Schopenhauer's phenomenological description of the manner in which this driven body is experienced differently in the affect of pleasure or displeasure, and in an objective representation sheds new light on the relation between the libidinal body and the objective body. Levinas' Heidegger-Kritik, der in seinem Totalité et Infini zweifellos grundlegende Bedeutung zukommt, stürzt zunächst in Verwirrung : der Begriff der Totalität, in dem nach Levinas Heideggers ontologisches Denken befangen bleibt, scheint nur ein solcher für das Sein des Seienden als solchen und im Ganzen zu sein, Levinas' Idee eines diese Totalität transzendierenden „Unendlichen” aber eher Heideggers Gedanken des Seins selbst nahezukommen ; der Unterschied zwischen Totalität und Unendlichem, den Levinas begründet, scheint fast ein Gleiches zu bedeuten wie die „ontologische Differenz” (...) bei Heidegger, hinwiederum aber bleibt für Levinas das Sein offenbar die bloße Totalität des Seienden, indessen es ein Seiendes par excellence, nämlich der Andere ist, das unendlich die Totalität übersteigt, auf die alle Ontologie das Sein des Seienden reduziert. Aber die reduktiven Tendenzen in Heideggers ontologischem Denken, auf die Levinas kritisch hinweist, sind in der Tat unverkennbar ; sie finden ihren schärfsten Ausdruck in Heideggers ausdrücklicher Zurückweisung der Ethik als einer eigenständigen philosophischen Aufgabe. Die zur Debatte stehenden Positionen lassen sich klären im Rückgang auf Husserl : dessen Denken scheint zwiegespalten zwischen der Reduktionsforderung, die hervorgeht aus dem Verlangen nach einem absolut Gegebenen als „adäquat” Gegebenem, und dem Festhalten an der Gegebenheit auch von solchem, was nie adäquat gegeben sein kann, als einer „originären”. Vielleicht trifft es zu, daß Heidegger bei all seiner Kritik am Begriff der Wahrheit als Adäquation doch aufs entschiedenste Husserls Tendenz zum Rückgang auf adäquate Gegebenheit, also die Tendenz der Reduktion vertieft hat, indessen Levinas -nach dem Vorgange von Merleau-Ponty -strenger auf dem eigenen Rechtsgrund des inadäquat Gegebenen als eines Ursprünglichen besteht. Hier geht es vor allem um die „Gegebenheit” des Anderen, die nach Levinas in primärer und originärer Weise ein moralisches Verhalten fordert -auch und gerade schon da, wo es sich „zunächst” um die „bloße Erkenntnis” des Anderen handelt. So ist es schließlich Levinas' Idee, daß überhaupt die Ethik die philosophische Funktion der notwendigen Selbstkritik aller Philosophie hat, in der diese ihre Geschlossenheit durch das Ausbleiben des Anderen unendlich in Frage zu stellen aufgefordert ist. Mag Levinas' Heidegger-Kritik in gewissem Sinne selbst sich auf einen Gedanken gründen, der Heideggers Idee der ontologischen Differenz verwandt ist, mögen ohne den Blick auf diese Idee die Streitfragen undeutlich bleiben, die jene Kritik aufwirft, es sind doch Fragen, die in ein Dunkel eindringen, das der „ontologischen” Aufhellung sich bislang entzogen hat.
